Use of Drones to Memorialize Accident Scene & Evidence

Now, more than ever, evidence and accident scene inspections must follow the CDC’s social distancing guidelines. Drones maximize what can be seen and minimize human contact. Live drone video taken can be a screen share to a Zoom meeting where interested parties far away can also participate in an inspection.

This presentation will introduce attendees to use of drones as inspection tools, explain how they work, give practical applications reliably used today as well as vivid examples of some of their uses. We will explore the different kinds of drones, their basic components, their operational capabilities, and the rules and regulations that must be followed in their operation. Attendees will understand the opportunity to use the map view and 3D model as demonstratives for the courtroom. Attendees will leave with a good understanding of the technology, its application as it applies to their specific professional efforts, costs and accessibility.

In this presentation, CED’s decades of experience will be distilled down to deliver a set of recommendations on how to select and work with engineering experts and understand the tools in their tool box to investigate claims arising from casualties such as fires, explosions, vehicular accidents, structural collapses, boiler machinery and equipment failures, gas and water leaks, and a variety of nature induced losses such as windstorms, earthquakes, floods, and hurricanes.

William H. Daley IIIWilliam H. Daley III – Bill Daley is the President of CED Technologies Inc. Mr. Daley holds a Bachelors degree from the United States Naval Academy along with a Masters Degree from the US Naval Postgraduate School. Prior to joining CED Technologies in 1995, Mr. Daley served on active duty for 20 years in the U. S. Navy. Approximately 90 percent of all accidents occur due to human error. In spite of their awareness of the risk, experience, training, and knowledge, people often make decisions and behave in ways that increase the risk of an accident or injury. In some cases, accidents occur due to an honest mistake. In other cases, people intentionally break from safe practices. These situations make human factors an essential assessment in a wide range of complex accidents involving commercial trucking, automobiles, railroads, aviation, utilities, construction, mining, oil and gas, manufacturing, medical devices, as well as consumer and commercial products.

Human Factors experts examine human performance under given circumstances, how they perceive risk and make decisions, and what motivates safe or unsafe behavior. This course will provide the audience an understanding of the various human factors issues that contribute to accident causation in cases related to transportation and product liability. Factors such as risk perception, gaze behavior, perception-response time, visibility and conspicuity, driver decision-making, fatigue, inattention, warning adequacy, and warning compliance, etc. will be discussed to help the audience understand key issues in such cases. Case studies will be used to help the audience understand how to use human factors experts.

Farheen S. Khan, Ph.D.Farheen S. Khan, Ph.D. holds a B.S. in Industrial Engineering and an M.S. and Ph.D. in Industrial and Systems Engineering from the University of Wisconsin, Madison. Module 1: Confidence

This workshop will provide participants with the means to identify, understand and promote one’s individual value proposition, an essential component for effective leadership and business development. We will address the importance of self-advocacy as well as how each Rising Leader can both position themselves and others to be ambassadors for their personal brand and the brand of their firm. We will discuss the creation of stakeholders in the community, including peers and referral sources, and establish criteria for qualifying and cultivating “best clients”. There are many choices in methods and assumptions that an economist makes in calculating a damage award which can result in widely varying awards. Some of the key areas of economic choice include:

  • Discounting Losses to Present Value: Two main types of discounting methods are used: Current Market Yields vs. Historical Average Yields. Although large differences in awards can result between the two method types, large differences also can result within each method, especially from the choices made within the historical method. Pros and cons between the methods and relative magnitudes of possible awards are analyzed.
  • Future Earnings Growth Rates: Choices include: Using plaintiff’s own recent earnings history; Economist using his/her own growth assumptions (e.g., inflation + x%); Relying on authoritative US government forecasts from Congressional Budget Office or Social Security Trustees. Large differences in possible awards from choosing between the two government forecast sources are examined.
  • Work Life Expectancy (WLE): Rather than simply assume a demographically-based average WLE, economists can apply discretion. Examples include substituting a specific retirement age, or adjusting WLE based on factors such as a plaintiff’s time out of the labor force, erratic work history, or the severity of injury, which can be used to justify a shortened post-injury WLE or no return to work at all. Challenges in the latter case may entail collaboration with a Vocational Expert.
  • Loss of Household Services: Loss of household services applies not only in cases of wrongful death but also of personal injury. Discretion exists with varying results in two main ways: The basis for assigning a future loss period, i.e., Joint Life Expectancy (JLE), Healthy Life Expectancy (HLE), and Full Function Healthy Life Expectancy (FFHLE); and the value assigned to mitigating losses, which in turn will vary with assumptions about age, work status, marital status, and household composition.
